1. Agreement to Terms

These Terms of Service (“Terms”) form a legally binding agreement between you (“you,” “User,” or “Customer”) and Furrvi AI Inc. (“Furrvi,” “we,” “us,” or “our”) governing your access to and use of Furrvi Photo, including our website, portrait generation services, and related features (the “Services”).

By purchasing, accessing, or using the Services, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the Services.

2. Eligibility

You must be at least 18 years old to use Furrvi Photo.

By using the Services, you represent that:

  • You have legal capacity to enter into this agreement

  • All information you provide is accurate

  • You have rights to all submitted content

3. Description of Services

Furrvi Photo provides:

  • AI-generated pet portraits based on user-submitted images

  • Style/template-based image generation

  • Digital delivery of generated outputs

This is a transactional creative service, not a social platform or storage service.

We may modify, update, or discontinue features at any time.

4. Orders, Payments & Delivery

4.1 Orders

  • You purchase portrait packages (e.g., 1, 3, or 5 images)

  • Orders are processed after successful payment

4.2 Payments

  • Payments are processed via third-party providers (e.g., Stripe)

  • We do not store payment details

4.3 Delivery

  • Outputs are delivered digitally (e.g., email or download link)

  • Delivery timelines are estimates, not guarantees

4.4 Refunds

  • Due to the custom nature of AI-generated outputs:

    • All sales are final, except where required by law

    • Refunds may be issued at our discretion (e.g., technical failure)

5. User Content

“User Content” includes:

  • Uploaded pet images

  • Inputs, selections, and prompts

You retain ownership of your original content.

You are responsible for ensuring:

  • You own or have rights to the images

  • Content does not infringe third-party rights

6. License to User Content (Critical Clause)

By submitting User Content, you grant Furrvi a:

Worldwide, royalty-free, perpetual, transferable, sublicensable, non-exclusive license to:

  • Use, reproduce, modify, and process your content

  • Generate AI outputs and derivative works

  • Train and improve AI/ML models

  • Create templates, styles, and system improvements

  • Use anonymized or aggregated data for:

    • Research

    • product development

    • demonstrations and marketing

You acknowledge that:

  • AI outputs are generated using probabilistic systems

  • Furrvi owns all system-level improvements, models, and generated styles

  • You are not entitled to compensation from downstream uses

This clause is non-negotiable for protecting your data moat.

7. Generated Content & Usage Rights

You receive a personal, non-exclusive license to:

  • Download and use generated portraits

  • Share them for personal or social use

You may not:

  • Resell outputs as stock or standalone assets

  • Claim ownership over underlying models or styles

  • Reverse-engineer or replicate the service

Commercial use requires written permission.

8. Prohibited Conduct

You agree not to:

  • Upload unlawful, infringing, or harmful content

  • Submit images you do not have rights to

  • Attempt to reverse engineer or exploit the system

  • Use the service for fraudulent or abusive purposes

We may suspend or terminate access at our discretion.

9. Intellectual Property

All rights in the Services are owned by Furrvi, including:

  • AI systems and models

  • Templates and styles

  • Outputs at the system level

  • Platform design and branding

Nothing grants you ownership of Furrvi IP.

10. Data Use & Privacy

All data handling is governed by our Privacy Policy.

By using the Services, you acknowledge:

  • Data may be used to improve AI systems

  • Data may be processed across jurisdictions

  • Aggregated and de-identified data may support broader product development

Furrvi does not sell personal data.

11. International Users & Compliance

Furrvi operates globally and complies with:

  • GDPR (EU)

  • UK GDPR

  • PIPEDA (Canada)

  • CCPA/CPRA (California)

Users may have rights to:

  • Access

  • deletion

  • correction

  • objection

12. Termination

We may suspend or terminate access:

  • For violation of these Terms

  • For misuse of the Services

  • At our discretion

You may stop using the Services at any time.

Important:
Anonymized, aggregated, and model-derived data may be retained.

13. Disclaimers

The Services are provided “as is”.

We do not guarantee:

  • Specific artistic outcomes

  • Exact likeness or realism

  • Uninterrupted or error-free service

AI outputs may vary in quality.

14. Limitation of Liability

To the maximum extent permitted by law:

Furrvi is not liable for:

  • Dissatisfaction with generated outputs

  • Loss of data or content

  • Indirect or consequential damages

Total liability is limited to the amount paid for the Service.

Nothing excludes liability where prohibited by law.

15. Indemnification

You agree to indemnify Furrvi against claims arising from:

  • Your uploaded content

  • Violation of these Terms

  • Infringement of third-party rights

16. Changes to Terms

We may update these Terms at any time. Continued use after updates constitutes acceptance.

17. Governing Law

These Terms are governed by:

  • Laws of British Columbia, Canada

Where required by law:

  • Local consumer protections may apply (EU/UK users)
